Dear All

I have downloaded the utility the excel utility file from aces website for the period October2012-March 2013 and i have just keyed all datas in the win rar format itself without extracting the  file from WIN RAR and converted that File into XML Format and uploaded the same on 23.8.2013.My queries are

1.Will the XML File Contains datas what I have Uploaded?

2.If the Answer is negative can I file a Revise Return immediately?

Please advise I  made a local call to the service tax Range to get clarity on that but no one is picking up?

Please give your valuable replies so that i can act fast on the same

I think the data would be present in XML File. If u have any doubt on ur upload, u can download the  Xml file and see the figures which u entered whether it presents or not.

                                               OR

If u want to revise the return u can revise within 90days from the date of original return is filed. u can file the revised return immediately, no restriction on that

Dear Sirs / Madam

That we are doing business Trading cum Commission Agent, so Cenvat cannot be adjusted fully. Whether the assessee is not entitled to retain full Cenvat credit of such input or input service. Such assessee has option to maintain separate accounts and should take credit on only those portion of input or input service, which was used for taxable output. However, for certain input services like Security service, Chartered Accountant service, Telephone service and Annual Maintenance contract service, maintenance of such separate accounts is NOT POSSIBLE. So, the assessee has to pay an amount equal to 6% of value of such non-service activities under Rule 6(3) of the Cenvat Credit Rules.

Our Total Turnover is 3 Cr,

Other Income ie Commission 27 Lacs,

Service Tax on Comm 3.3 Lacs

Cenvat credit on Telephon, Mobiles & Etc comes to 1.5 Lacs

balance amount we paid to Dept Sir Pls help us how to calculate for the above under rule 6(3), Please do the needful.
