Outstanding tax demand resolution?

I was suppose to get a refund from IT a couple of years back.

I asked my CA to look into it why I am not getting the refund where as all my other family members received their respective refunds. But may be they didn't look into it that seriously and even I got busy with life.

Again for last year I was suppose to receive refund but this time I received an email saying the refund amount is adjusted against the previous Outstanding Tax Demand of year 2008.

I managed to get into the IT website and looked for the section, "Outstanding Tax Demand". Sure enough there is a big amount that's showing outstanding for 2008.

I contacted my CA and they did some digging and realized one of the advance tax that was paid for that year was not taken into account by the IT department for calculating final tax liabilities.

P.S. The taxes were filed offline for that year so contacting the phone at bangalore did not help for me.

My CA filed the rectification request to IT dept about 2 months back.

I want to know roughly how long does it take to rectify this issue?

Secondly, I believe the penalty is somewhere like 1% per month? So for ex. if I had 1,00,000/- Rs. as outstanding tax demand for 2008, for which we never received any intimation from IT dept, what will be the current outstanding amount with penalty and interests?

Rectification request will be resolved within 6 months.

If you have made the payment offline, you must have the Original Payment Challan to prove yourself; also check 26 AS on IT Website for the same; it'll show the amount paid by you & the TDS due to you. If you have filed offline IT Return, check out in the local IT office for rectification along with Paid Challans, IT Return & 26 AS; they normally rectify it on the spot.
