Hi,

I had submitted my filing for AY 2014-15 last month by online filing. I have got a notice u/s 245 email from IT dept saying the refund will be adjusted with outstanding demand from AY 2010-11. I had never got this demand notice in last 4years.

I had only salary income in AY2010-11 and TDS through my employer.I have got filing attested for that financial year and not outstanding balance as per that. I am outside country for next two months and cannot contact the AO. Can you please suggest what i can do?

Please check your Outstanding Demand online on incometaxindiaefiling .gov.in portal in My account column .

Then apply for a copy of Intimation u/s 143(1) in Assessment Years in which it shows Outstanding Tax Demand.

Check your Intimation if it shows any Tax Demand.

Your Demand May be due to non receipt of Credit of TDS Deducted due to various reasons.

If intimation shows no demand and Income Tax Deparment Shows Outstanding Tax Demand then write letter to your Assessing Officer for the same and do Speed Post for retification along with all the copy of TDS Certifiacte and Tax Paid Challan if any. .

there might be a prb with tds mismatch in your case... if you are going out of station, then visit any CA or tax consultant and give them power of attorney to appear before AO on your behalf and settle your case.

Hi,

Thanks for your suggestions.

I found O/s demand notice under my login in IT website. I have applied for copy of intimation.

I am already outside country and cannot return back to meet the AO or make power of attorney for next 2 months. Please suggest me how i can communicate with AO staying here? Notice says i got just 15 days to meet AO.

@ ismail... if it is just a case pf tds mismatch then you dont need to worry, you can visit your AO after you return home.

another option is that you consult a CA or tax consultant and ask him just to make a representation on your behalf (not to act on your behalf) to put a stay on notice of 245 till you return.
