Modification in IEC Code of the Company

Dear All,

I want to change of address in IEC code Certificate. i got information but some confusion for my mind.

1. I want chages in companies address so whose attached photo in modification form becasue it is a co.

2. please provide me procedure & enclsing doc. list

Modification of Address in IEC

In addition to updation of IEC, if there is any change in the existing IEC, like change of directors, change of name or constitution, change of address or addition/deletion of branch, the following documents are required to be submitted.

Request letter on Letter Head for Status Modification.
Application as per Appendix 2 and 3 in duplicate.
Documentary evidence preferably Electric bill, telephone bill, lease agreement copy, Sales Tax/Excise Certificate/SSI for change or inclusion of addresses. For change of directors please submit copy of Form-32. In case of change of name or change of constitution, ROC/Partnership deed copy as applicable should be submitted.

Also refer to para 9.1(b) of H.B.2002-2007 regarding change in name and constitution is reproduced below.

" If there is any change in the name/address or constitution of IEC holder/licencee/Actual User eligible for import without a licence/recognised status holders, the concerned IEC holder/licencee/Actual User/status holders, as the case may be, shall cease to be eligible to import or export against the licence/IEC N0. or any other facility permitted under the Policy and Handbook, after expiry of 60 days from the date of such change in his name or constitution, unless in the meantime,

the IEC holder/licencee/status holders has got the consequential changes affected in the IEC NO/licence or the recognition certificate, as the case may be , by the concerned licensing authority;
the Actual User has got the consequential changes affected from the concerned authority in the industrial licence issued by the Secretariat for Industrial Assistance (Ministry of Commerce and Industry) or Certificate of Registration as an Actual User issued by Director of Industries of the State Government or has received an acknowledgement for filing of a memorandum with the Secretariat for Industrial Assistance. Provided, however, the licensing authority issuing the IE Code may, condone the delay on payment of a penalty of Rs.5000/-.

However, the change in the director of a public limited company shall not be considered as a change in the constitution of the company."

Penalty of Rs.5000/- payable in favour of Licencing office (Jt.D.G.F.T, Mumbai in case of Mumbai office) by Challan or DD, in case of delay beyond 60 days as per para 9.1(b) of H.B.2002-2007 reproduced above is applicable in the following catagories.
Change of address of Registered Office of the firm/company. Note: Date of change of address shall be either the date of agreement or the date of occupation of the new premises. In case of change of address of registered office to a branch/factory/residence address of the IEC holder already included in the IEC, self declaration of the IEC holder regarding date of change of address will be accepted.
Change of Partners.
Change of directors of a Private Limited Company.
Change of Proprietors in the Proprietorship concern.
Change of name of the firm/company.
Change of constitution.

Note

: Penalty in case of delay will not be applicable in case of Inclusion/Deletion of branches/divisions/factory address

Self addressed envelope affixed with Rs.25/- Postal stamp.
Original IEC Certificate.
RBI declaration on the Letter Head as per sr.no.6 of Foot note to Appendix-3 in case of change of directors/partners/prop./Karta of the firm/company.
Self Certified copy of PAN. In case of Mumbai office Submit Documents on the 2^nd floor, North East Wing, IEC Counter, between 10.00a.m. and 12.30p.m. from Monday to Friday.(Please tag all the documents to a folder)

1) u must also put DD for Rs.1000/- for modification in IEC

2) Address Proof also such as a telephone bill on the address which has been changed

Hi!

I have doubts for filling the modification In IEC

whether the IEM copy can submit as aproof for the Modification in IEC.

No fee is required for inclusion of PAN no. in the old IEC.

AND AFTER FILLED UP FORM SEND THIS IN CONCERNED REGIONAL LICENSING AUTHORITY AND ENCLOSED THE

Self addressed envelope and stamp of Rs.30.

These documents may be kept secured in a file cover.

Subject:- Provision of additional facility for filing Importer Exporter Code (IEC) applications “on-line”.

DGFT is introducing additional facility on DGFT’s website (https://dgft.gov.in) for enabling members of trade to file their IEC applications ‘on-line” with effect from 1.1.2011.

Presently, the applications for obtaining an IEC are filed manually with the concerned Regional Authority of DGFT. The applications are filed in hard copy in the prescribed proforma with stipulated documents.
The additional facility of filing “on-line” application for obtaining IEC will reduce the transaction cost and time for the applicant, would ensure easy, flexible filing of application and reduce human interface and paper work in the process.
The existing system of filing the IEC application manually would simultaneously continue till further orders i.e. the applicant will have an option to prefer his application either manually or “on-line” as per his/her convenience.
The following guidelines and procedures are stipulated for the “on-line” system of filing, processing and issuance of IEC:-

The applicant may file the IEC application for “on-line” through the link available on the DGFT’s website.
The fee in case “on-line” application for IEC has to be paid through Electronic Fund Transfer (EFT) mode only. The EFT link with necessary guidance for making payment through EFT is already available on DGFT’s website.
The prescribed documents, i.e. the Bank certificate, PAN copy and photograph, are to be scanned and attached with the ‘on-line’ application. Any other relevant documents for example Authority letter in respect of authorized representative, should be attached in the ‘pdf’ format.
Physical copy of application is not required to be submitted to the concerned Regional Authority(RA) in case of “on-line” applications.
The status of IEC “on-line” application i.e. IEC number granted for accepted applications and deficiency in case of other approved applications will be available on DGFT’s website.
n case, an “on-line” application is found to be deficient and such deficiencies indicated ‘on-line’, additional information/documents against such deficiencies would need to be submitted physically (in hard copies) to the concerned RA.
The applicants are advised to be very careful while selecting jurisdictional RA for sending their applications, as selection of a wrong RA would require retransmission of application to the corrct destination and it is likely to cause delay in processing.
Comprehensive guidelines regarding filing of “on-line” IEC applications are available on DGFT’s server under the IEC “on-line” Help Icon.

Members of Trade are encouraged to take advantage of the “on-line” facility for IEC application and RAs are requested to disseminate the information about the facility among the Trade.
