Lease of a flat

I leased my flat for a rent of 7500/- and entered into a 11 months agreement on 20/- stamp paper. It expires on 22/4/2012

The tenant  told me orally in october that he will vacate my flat inNov,2011.I leaned from my secretary of the flat that he vacated the flat in the first week of Nov,2011. Actually the tenant told me that his borther will come stay in the flat and as per agreement he will pay me the rent. He didn't give me the key after vacating the flat. Now I could not contact him the ph number which he has provided me. when i sent a regd letter to the native address which he has given in the agreement, returned to me two times stating that the address is false.. no such address. Past two months he didn't pay me the rent. He paid me an advance rent of 40000/- in which i am accounting (deducting) the rent..I dont know whether he fully vacted my flat? Please advice me what i have to do to evict the tenant and take possession of my flat....

     Mr Sankaran,

  First consult your lawyer,check up what you can do as per the rent agreement.When the necessary waiting period is over,take the help of police and your lawyer and break open the house or with your key.Make a list of any items left out by the tenant with your lawyer and police as witnesses, keep thm aside and occupy your flat.......MJK
