Hi friends...

I have filed ITR V . I have sent the hard copy to CPC Bangalore by courier. Later on I came to know that they would not accept the return if they were received in courier. But the time limit of 120 days has been elapsed. So Kindly clarify whether i have to file the belated return. Also let me know the procedure.

I have seen the cases wherein the assessee recieved a mail communication from the IT Dept requesting to send a signed copy of ITR-V post 120 days to process the return.

But it is always better to play safe by filing the revised return with the same info rather than to wait for the call from IT Dept and also send the revised ITR -V in this regard thru Speedpost.

Thank you so much for prompt reply... Kinldy clarify whether i should have to file revised or belated return? Because revised return can be filed only if the original return was filed before due date. In my case, i have filed the return electronically before due date. Also i sent the hard copy through courier before due date. They wont accept the return if they were received the return in courier. Now 120 days has been elapsed. Thats why I have asked.

Chitra,

From your side, technically speaking you have filed the return but defaulted only by not sending the ITR V. It doesn't mean that you didnt file the return at all.

now you need to file the revised return. Belated return is not applicable for you 200%.

CPC has now extended the date of the returns that are filed and not sent to bangalore from A.Y.2010-11 which is 31st Dec'12. So you can now send it by Speed post / Ordinary post ASAP
