issue regarding tds

i need a clarification regarding tds... my client havn't deducted tds becus the parties dont have pan ,,,they say that it will be a problem if they deduct tax from parties while filing tds returns as they have to quote pan no's of the concern party... pls let be know...what can be done...n if the client doesnt deduct tds wat are the consequences with regard to it...

Ur client have to deduct the TDS if any payment is liable to TDS. And for your kind info. you can file the TDS return if any party doesn't have the PAN No. and in return you can just mention the PANNOTAVAILABLE. Ans as you told that if client doesn't deduct the TDS & then he made a default & then he has to deduct & deposit the TDS with interest.

You can ask your client to apply for PAN and for meanwhile you can pay tax deducted from his income and follow the procedure provided in this link.
