House rent deduction in efiling

Efiling 566 views 1 replies

Hi,
I am filling up the efiling for assessment year 2014-15 online. I am working in a private IT company as a professoional contractor. Company had paid TDS, 10% of my Proffessional Changes. So, I have to fill the return file myself. I am residing in a rented house in Kolkata & giving rent 7,800 per month. Now I have following questions (please don't mind on silli questions):

1. On "Personal Information" tab, for field "A20. Residentail Status" what should I need to select among the following options:

  •     RES - Resident
  •     NRI - Non Resident
  •     NOR - Resident but not Ordinal Resident

2. For field "A.21 Return filed under section" what should I select? Note that I have not filled earlier for this year.

3. Where should I put the house rent for deduction (which S.No and section) and how much maximum amount can be put there?

Thanks!

A.20: You should select RES-Resident if you stayed in India for F.Y 2013-14  for 182days or more. Nevertheless concern to select NRI or NOR. You should select NOR if you are Non-Resident( Stayed in India for a period of less than 182days) for 9years out of 10 Preceeding previous years i.e you should check whether you are Non-resident for any 9 financial years from F.Y:2003-04 to F.Y 2012-13. Generally if you are not frequent to stay out of India then obviously you can select RES

A.21: If your concern about return for F.Y:2013-14 then it is belated return. If you file your return before July,2014 then select 139(1) otherwise select 139(4) belated return.

Rent paid can be taken as deduction u/s.80GG while filing Income tax return if you are not in receipt of HRA. If you are in receipt of HRA then HRA exemption will be lower of following

50% of Rent paid

Rent paid - 10% of salary

Actual HRA received.
