If you are PCC student (3.5 years articleship) excess leave =106 days

If you are IPCC student (3 years articleship) excess leave=136 days

Kindly note that eligible leave is 1/6th of "No of days served" and not 1/6th of total period.

For example If you are IPCC student (3 years articleship) the leave is calculated as follows:

(a)Total days of service (365*3)         =1095

(b) leave taken                                        =(273)

 (c)No of days served     ((a)-(b))         =822

(d)Eligible leave (1/6th of (c))               =137

(e)Leave taken                                        =(273)

(f)Excess period to be served (d)-(e) =136

As per ICAI guidelines:

"An articled assistant shall earn at the rate of one-sixth of the period for which he has actually served, excluding from such period, the period for which he has been on leave subject to a maximum of 180 days."

I’m assuming you are an IPCC student.

So, aticleship period: 365*3 (yrs)   =1095 days

Less: Leave availed                            = 273 days

Actual period served                         = 822 days

Therefore, you are eligible for 1/6^th of actual period served i.e 137 days.

Hence, you will have to serve additional period of (273-137) 136 days.

You will have to submit Form ”107” i.e Deed of Supplementary Articleship for the same.
