franchisee pays certain fees and agrees to comply with certain obligations, typically set out in a Franchise Agreement.

If you are issuing bills to customer in your own name then you fall under the definition of Agent .
If the billing is done to customer in name of franchisor it will not cover under Defination of commission Agent .
