We are working on a portfolio where we recd commission from restaurant. now we need some clarity which can help us to do business

1. Can restaurant take input credit of the GST amount which we have charged them in lieu of commission ?? as restaurant is restricted to take ITC as per GST laws

2. Who is the responsible to pay GST ??? Our Company as we taking commission or the restaurant who are giving commission ???

3. what is the turn over limit for business whose having all income in commission.

4. we are e-commerce portal for food lovers (just like zomato as they are giving deliveries and we are selling coupons for dine-out at restaurants kindly do the needful

1. No ITC available to restaurants.

2. Service provider, i.e. your company.

3. For commission income, no basic exemption limit.

4. For E-com check RCM liability, mandatory registration liability etc.

1) No.. since they are paying tax at concessional rate i.e 5%
2) you are required to raise commission invoice and pay tax
3) no..there is no limit you are compulsory required to register under gst
