Gratuity for an employee aged above 60

Dear experts/Auditors 

One query regarding Gratuity...

A person who is aged 65 years was employed in a concern and that company got wound up. This particular employee was employed for 10 years in that company..is he eligible for Gratuity....if he hasn't got Gratuity what are the legal remedies..Kindly confirm..

Gratuity can be received by the employee on the following criteria:

  • The employee has to be eligible for superannuation
  • The employee should have retired
  • The employee must have resigned after completing 5 years with the same employer
  • The employee dies or suffers with a disability caused due to an illness or accident
