If a person fill fw8ben and tax is deducted at 15% then whether he will get the benefit if same tax deducted in india or it is shown in his pan no or not. what are the implications after filling form w8ben

You would be entitled to take credit of WHT deducted in foreign country provided said income has been offered to tax in India. All you need to do is to file Form 67 for claiming such WHT as tax credit and then only need to file income tax return.
