Filing returns - PAN has maiden, 16 has post-marriage name

Hi,

My wife is salaried employee, and has her PAN card in her maiden name, while the Form 16 has the post-marriage name (PAN number on Form 16 is same). Is it okay if she goes ahead and does efiling? She will file returns in her maiden name, but furnish information from her Form 16 which has post-marriage name. Is there a mandatory requirement to get the name changed either on PAN or on Form 16? (I ask since its just about two weeks remaining to the filing deadline, and I wish to avoid making any changes now).

I think its not complusory to have same name on Form -16 and on PAN Card. I have the same Case. I have my Form-16 without my Surname but Pan card with Surname.

But i am not sure.

No Issues about the name, Just ask her to file returns with the name given in the PAN Card.

You should make a change in the PAN card of your wife mentioning the post marriage name.

Request for change (significant change) in applicant's or father's name will have to be supported with such proof that will contain proof of change of name from the old to the new in addition to the proof of identity. The documents that shall be accepted as proof in this case are:

  1. For married ladies - change of name on account of marriage - marriage certificate, marriage invitation card, publication of 'name-change' in gazette, copy of passport showing husband's name (or vice versa).

 

For the time being...make an application for change and then file your return in the old name.

I hv a client with similar problem. in my opinion if its a no refund case then go ahead n file the return. But if refund is there then file the return in maiden name so that u get the refund. After getting the refund apply for the name change as sugested by prateek.
