DIN Form 3

NO a chartered accountant cannot sign DIN -3. It has to be signed by a Company Secretary.

Except Company Secretary, no other Professional can sign DIN -3.

Only CS has the authority to sign the DIN 3.

Form DIN 3 is very clear on the matter. Accordingly, only CS, and no other Professional whatsoever, can digitally sign it. Surprisingly, this is the only Form under MCA which a CA cannot sign. Also, the reason for the exclusivity conferred on CSs is difficult to digest. Practically, DIN 3 is prepared by a CA, but some CS needs to be brought into picture for such small and avoidable purpose only, but at a price. The relevant Rule needs to be amended immediately to avoid inconvenience and extra cost to the Company.

Moreover, I dont think it the rule should be amended. A CS is a dignified professional too and if a CA can sign all forms of MCA why cannot single form be left for CS's. You are forgetting that its the Company Secretary of a Company who is the compliance officer and answerable for all legal doings. so the rules are correctly laid dowm. In all the other forms that you are talking about its the Company Secretaries who first sign and then the CA has to authenticate the same. So the role of both is equally important.

plz give me DIN forms

We have formed a new Pvt. Limited company .The Directors of our existing company are also Directors of new company. The Form No.32 is already filed by the new company. Do we also will have to file DIN-3 from the new company? Please advice.
