Demand notice u/s 143 (1a)

Notices & Assessments 2178 views 10 replies

Recently I registered on incometaxindiaefiling.gov.in website. And to my suprise I found that there is a Outstanding Demand Amount of Rs. 35000 for AY 2010-2011 U/S 143(1a). The date of demand is 22/11/2011. The reurn was filed on 27/07/2010 and the acknowledgement receipt from IT depptt was dated 10/08/2010. Can someone suggest if the demand notice is valid as it is dated 22/Nov/2011.  What should be my action point if it is valid? What should be my action point if it is invalid? P.S. I also checked the TDS entries in form 26AS with the ones in my IT return and all are matching. There is no discrepancy. I also cross checked my income with various tax calculators and I am certain that the tax paid by me is correct. Any help on  this would be deeply appreciated.

Thanks in Advance

Thanks for the quick reply.

Would you be able to guide me, as to what should be my next step. The demand notice is already more than 2 year old. Ihave not responded to this demand notice as I believe I have paid the correct taxes. I have requested an intimation 2 months back on the income tax website for the relevant year , but am yet to receieve anything i n this regard.

u r saying that tax paid by me is correct.... then check demand of rs 35000 is on accout of what????

if you think there is mistake from deptt end  then u can file application for rectification of error...  this is my point of view.. i m not 100% sure

i received intimation u/s 143(1) for the return filled for FY 2013-14 filled on 24/07/2014, i have come to know that an amount of Rs 850/- is outstanding for tax demand. after paying this outstanding demand what should be my course of action, should i revise return or sending proof of payments to department? Pls suggest

Today I received a demand notice. But I believe it is incorrect. CPC Has computed it incorrectly.

STCG seems to have been added twice by CPC.

What should I do? Help is appreciated.

I have attached the complete intimation by CPC.

Appreciate any help how to resolve the issue of incorrect demand by CPC.

Go to efiling and rectify - select the third option - " Reprocess the case"

Double Check you capital gain records, as the department collects  information through AIR filed by the depository or trading plateform,

No I dont think thats the case. Because from the calculation i hve mentioned the STCG as 25112 but CPC has computed it as 50224

Hi

I did go to efiling and rectify - select the third option - " Reprocess the case"

But again the same outcome.

Can someone please help me identify what is wrong with CPC. Its such a simple calculation according to me. Their calculation of GROSS INCOME is grossly incorrect. Even a 5th standard boy can do the maths. The trouble is how to get it corrected. Filing a rectification request has also not helped.
