Condonation of delay

A Company has filed Form CHG-4 for satisfaction of charge with a delay of 50 days. The Company has now received a Notice for Condonation of Delay under Section 87 of the Companies Act, 2013. I am in the process of filing Form CHG-8 for application to the Regional Director. In the application I am choosing the option as "Delayed filing on Satisfaction of Charge" as is the case. The Other option being mistatement or ommision which is not applicable in this case.

I wish to know what documents need to be attached to the Form for this. It shows only two docs as compulsory attachments :

1. No due Certificate of the Bank

2. Resolution authorising Director/ CS for the application.

My query is that do we need affidavit, petition etc. if it is only for delay and not for ommission / mis-statement

Please guide

condonation of delay in filing CHG -4 only if delay is 300 or more days. since it's only 50 days in your case, condonation is not required
Condobation is required even if you file beyond 30 days for satisfaction of charge
