Hey,

I had received a stipend cheque when my articleship is finished from where i pursued my articleship and now i have to return in cash. half of the amount of stipend amount is returned by me.

i have a clear video evidence against Senior partner of my firm that he received stipend from me and delaying in signing of form 108.

and he said that, he wont allowed signed on my form untill full amount is not been retrun to him.

i want to complaint against that kind of person.

please advise me for it.

Procedure to file a formal complaint

The Complaint and its enclosures should be filed in triplicate, duly signed by the Complainant and should be in English language. Any document/s in Hindi or in any Regional Language should be sent along with English translation thereof duly verified as `true copy’ to save time. Further, as per Rule 4, the Complaint should be accompanied by a fee of Rs.2500/- (Rupees Two Thousands Five Hundred only) in favour of “The Institute of Chartered Accountants of India” payable at New Delhi.”

If u had done genuine articleship then, u can file such complaint, else it may make problems in your articleship completion and even on final attempt. Like talk to him once on point and then take such step.

U can do it but beware icai may also enquire for the chance of existence of dummy articles which would be a lengthy process

i have a photos of attandent register (5 months) as a proof that i had serve my articleship and audit reports on which my name is mentioned that i was a part of audit team.

Then there is no problem but try to talk and settle with yourr principal instead of going to icai , same type of problem happened with me I negotiated with him I worked for extra 2 months free to get rid of him his ego was satisfiedand left firm and took up industrial training which is far better than stupid ca firms where there is no future

But it's of just 5 months and articleship is of 3 years. And even he is in position and must be having good contacts so try to settle it at your level

icai will take long process to solve it, if u ready for it then u can go, it may affect ur final attempt also. so think twice before u go.

Just try to negotiate with ur principal, dont panic nobody can hurt ur chances to a better future. Try and reason with him, maybe work for him at a lower stipend instead of returning him. CUT URSELF A DEAL.

Try to become a CA than making a complaint with ICAI. You have a very bright future and be a CA at the earliest.

My friend was also having a same problem in Delhi. He just met with the Joint secretary in Delhi. At that time Joint Secretary made a call to CA which was recorded and also asked him why he is creating such a problem. If you have done genuine articleship just make a mail to our Joint Secretary or have a visit.

And i want to tell you that our institute always come to us as a helping hand.

Just Mail and you will see the action.

Honestly its a very unfortunate situation for you to be caught with such a dirty individual.Sad really.Just give him the money and get done with your articleship.Tell him to be happy with the money.Life aint worth going after such people.Karma will always catch up with him in the due course.So relax and dont waste your precious time on such folks.Life ahead for you is more precious.So dont waste your time.

never mess with principals because institute is nothing but a body being run by MEMBERS so at the end of the day its members who are benefited unless the matter is so pervasive.. so try to settle. once u receive completion letter then it's of no relevance so don't toss it career 3 yrs of artclshp brother thts priceless effort keep faith in ur honesty u will be benefited...

dear Hitesh,

Draft an email to Joint Secretary of ICAI about it in a humble manner.You are not the only one in India facing the same.You should be the one who is ready to raise a voice against the wrong happening done by members of those institute which in itself is a mark of Trust and honesty.

Hi , well the details mentioned by you might not give the complete picture. firstly it must be seen what was agreed between yol. i know im sounding silly here but i guess you will understand you i mean to say, Now coming to the complaint and all, remember one thing it depends on the person taking up your case / issue he might as well make a mockery of things and simply waste your time. If you are a cent percent sure that you have done things genuinely and this comes as a complete surprise to you then complain otherwise refrain from it. first get your completion letter and then take up the case if you have evidences. Tell your parents / guardians to have a word too.
