Clarity over salaried members in huf

Tax planning 635 views 1 replies

I was planning to get registered HUF for my family in order to create an additional taxable entity.

HUF will consist of My father, mother and me. Me and my father are salaried person.

We had been advised against HUF, by bank manager. Stated reason is that after creating HUF, all income (my fathers, and mine), will be clubbed and shown as part of HUF tax return, and salaried individual need not file individual tax return.

Please clarify negative implications of HUF on salaried members (karta/coparcener).

My tought was to create additional taxable entity, and then bifurcate/redirect our taxes (other than income from salary) towards HUF.

There is no such thing that your income will be clubbed with HUF. But you cannot transfer funds from your account after creation of HUF to HUF for tax planning as it will get clubbed as your own Income. You can transfer any ancestral property or funds received as gifts for creation of HUF.
