Hello Folks, 

I have a question regarding, how to avail HRA against rent paid during financial year. 

Here is a problem, I am a salaried person & had my Income Tax declaration done at the beginning of the financial year. I had declared house rent of 96000 to my company and throughout the year tax was deducted based on the calculation.  

We were told to submit proofs of all the investment by the end of January. While submitting proofs I forgot to add Rent Agreement. Because of which my company has considered minimum rent amount that is 36000 and deducted TDS. Is there any way I can claim full rent paid while filling ITR.

If anyone here know request you to provide procedure for the same, link, explaining how to do it would do.

While filing ITR, add exempted amt of HRA calculated by your employer to the total income of salary shown as Form 16 and now deduct HRA exemption calculation as actual rent paid i.e. Rs. 8000/- per month as per sheet attached herewith.

The figure so arrieved will be taxable income from salary.

I have a question.

As I said in my earlier post, company have already consider 3000 per month and using the same calculation you provided in the excel, they must have exempted some amount. Now, I want to increase the rent.

So, while filing ITR do I need to calculate difference of both?

Suppose Exempted amount by company calculation (considering 3000 rent) is

Exempt : 4000 Taxable HRA : 156000

& by revised calculation (considering 8200 rent)

Exempt : 66400 Taxable HRA : 93600

So, I assume my taxable income is calculated with HRA of 156000 & I need to revise it with using HRA of 93600?

So far I have submitted returns by filling all details from form 16 as it is. But in this case do I have to alter the HRA figure filled in form 16 or the excess rent I need to show in some different column? Which ITR I need to fill. 

Do I need to submit Rent Agreement? If yes where?

While filing the Income tax return,the HRA exemption amount you have to calculate afresh not considering the exemption amount calculated  by your company.

Yes ,you can increase the amount of HRA exemption provided you have supporting document, if asked to produce in the future.

Thanks Susmita for your answer. So, I can continue filing in ITR1 or should I use ITR2? 

If ITR1, according to your response I should recalculate column (Income from Salary / Pension (Ensure to fill Sch TDS1) )

ITR 1 for individual with :-

a) salary/ pension income.

b) income from 1 house property.

3)Income from other source (excluding Winning from lottery and Income from horse race)

Yes, you have to recalculate the same.
