I want to know whether the e-forms which are required to be certified can only be done by a Company Secretary in Practice and not by a Company Secretary in employment?

the E forms can be signed by Company Secretary in Practice only but can be signed by Chartered Accountant in employement or cost accountant in empoyement also.

The signing by way of digital signatures are required in the e forms in two ways. First one is signing the forms second one is certification the form.


 

Signing, can be done by any one who is associated with the company it may be Company Secretary, Director or Manager of the Company. However the certification can only be done by the practicing professional such as Company Secretary, Chartered Accountant or Cost Accountant in whole time practice.

sir in case of chartered accountant we have to fill membership no. so i think that chartered accountant in employment can also certify the e form

In the e forms following words are used, if CA comes under any of the category then he can sign otherwise not:-

 

To be digitally signed by

Managing Director or director or manager or secretary of the company (In case of an existing company, person signing the form should be different from the person in whose respect the form is being filed)
