We are the freight forwarder based in chennai. One of our customers is a manufacturer of home appliances and we serviced clearance and forwarding service to him. But unfortunately they have outstanding amount of Rs.28 lakhs with us and so we did not handover some BOEs of their shipments. Can anyone guide me is Bill Of Entry a must for the importer to take CENVAT credits and other credits? Can holding BOEs will get us payment from the customer? What are the advantages of BOEs?.
nothing to be done with BOE
B/E is must for importer to take cenvat credit on CVD and AED
B/E is must for CENVAT credit
Original Bill of Entry is must for availing Cenvat credit. But this aspect will reveal only when jurisdiction Superintendent of Range or Auditors asked them to produce the documents against availment of Cenvat, if they availed Cenvat against just BE Nos and Date or on the strength of xerox copies.
