Hey there,

 


 

My question is that

 

1)Can we go for voluntary tax audit u/s 44AB eventhough the turnover doesn't exceed 60 Lacs?

 

2)If yes, then what will be the last due date for filling of return?

 

3)If the assessee is engaged in Food products business, purchases the agricultural produce e.g. chillies from farmers & crushes himself and sells the chilli powder then whether he can fall under presumptive scheme u/s 44AD ?

NO. An assessee can not go for voluntary tax audit u/s 44ab. Only if turnover exceeds 60l then go for audit.

I beg to differ.Had a doubt.In case the person is willing to maintain the required books of accounts and all, then why can't he go for voluntary tax audit?I guess its compulsory for those whose turnover is above 60 lacs but even the ones below the limit are free to go fr it...

 

but as this is done on a voluntary basis(not under the compulsion of the act), they have to file the return before 31st july only...

 

Would like others to clarify my doubt..

audit and tax audit both are diff things, 

anybody can go for audit voluntarily, but tax audit ( reporting in form 3CD) is possible only 1) if turnover is exceeding 60 lacs for business / 15 lacs for profession 2) the net profit is lower than 8%

 

for voluntary audit there is no relaxation in return filing dates,

You can go in for voluntary audit provided you declare a profit below 8%. I feel any books which are subject to audit, due date is 30th sep as there is no seperate due date for voluntary audit or compulsory audit.

If profit is below 8% of the turnover then audit u/s 44AB is mandatory even if the trunover is less than 60 lacs. So it will not be called is voluntary audit and hence due date of the filing of return would be same as for the firms whose accounts are audited u/s 44AB.

you can get you accounts audited but it will not be stat audit ,

if you want to declare income less than 8% you need to get your accounts audited, but you will not have any relaxation in filing of returns

WHETHER VOULUNTARY TAX AUDITS U/S 44AB TO BE CONSIDERED FOR COUNTING CEILING LIMIT OF 45 TAX AUDITS PER CA???? PLZ REPLY..........
