Sir i have a order from USA but ship to India on of direction of USA hence I have rise bill to USA but goods ship to India oly my question it's possible for generate in eway bill on transaction type bill to ship if it's not bill to ship how to show in eway bill this transaction
I think it's possible to make e-way bill under bill to ship to model
But our auditor told me it's not possible because they given reason bill to ship oly domestic transaction section 10(1) (b)

Your auditor is correct but he might have not have interpreted it correctly. What you are doing is not export as the goods are not crossing the custom barriers and moving outside India. The goods remain in India therefore section 10(1)(b) applicable.

I think it's Deemed Export as per section 147 of the CGST act 2017 .
It's very confusing this topic because our auditor told me it's not all deemed export because goods can't supply against advance license or EPCG and section 10(1) (B) POS is principles of place of business of third party so can't apply this provision bill to ship they said like this

It is not deemed exports and it is neither exports. It is domestic supply of goods and bill to ship to will be applicable.
