Be positive about company secretary profession

Nowadays everybody is worried about Company Secretary Profession especially after release of KMP appointment rules by ministry of Corporate Affairs. But honestly there is no much to worry.

 

I think that new Companies Act will take the profession to new heights with the concept of KMP. It is a fact that Companies Act, 2013 has done away the with requirement of compliance certificate for small companies and pre certification of certain E-forms and Secretarial Audit is mandatory only for big Companies. But one should understand that concept like Secretarial Audit is all together is a new opportunity.
 

We should not think that we are just dependent on Companies Act. There are so many other laws such as FEMA, SEBI, DEPOSITORY, LABOUR LAWS, SERVICE TAX, VAT etc where we can make our career, so there is nothing to worry. Further MCA has recognized the importance of all these Acts with respect to Company Secretary Profession.

 

Actually on Social networking System few people are doing negative publicity. Those who think CS profession is all about ROC Form filing and secretarial work are actually worried....One should study properly and touch various branches/aspects of the profession like Foreign and International Law, Finance and Taxation and most importantly Legal.

 

Enhanced compliance provisions under new Companies Act, 2013 will surely help Company Secretaries in one way or other. So there is nothing to worry.

Absolutely sir.......

With the recognition as KMP, new avenues have emerged..

 

I totally agree with you that besides secretarial audit, there are many feilds.

 

Thank you sir for showing us the positive side of Companies Act 2013 as i read the post by some Cs which are posting totallly negative side about Cs profession even though i try to convince them that its not the end...if we have quality in ourselves we will find our way to shine in corporate world but they didnt understand.

Let's channelize our energy towards exploring new opportunities in Companies Act, 2013.. And for a matter of fact, please for once let's broaden our horizon and look for opportunities beyond Companies Act, 2013..sky is the limit for our profession and that limit is limitless! Best wishes to everyone..after all we are company secretaries not company law secretaries.

Dear Sir,

Thats inspiring and I'm absolutely of the same view.

I feel that few members by looking at its negetivity are spreading the negativity, by themseves being worried with a narrow view.

But I have one concern too. The drastic change from the rules stage has been left unaddressed by any regulators including our institute. They owe the responsibility to spread the positivity here to give better understanding of the scenario. The drastcity of the change has made all the impact. 

The rules should have been little lenient, not to give us so much shock.

Other companies also need to appoint CS for necessity under the new Act. But some legal backing to that effect was in need indeed, atleast to prevent the industry from outright dispelling of the employed members (as few places lack the understanding). 

But when we are on the strong area of governance which is the need of the day and ofcourse a high end area which is very vast, we need not to worry. Change is mandatory and inevitable. Regulatory's support is there indirectly now and we may hope for the betterment of the same in coming days.

There is a need to spread more and more positive thoughts at present situation.

It is true....at present 70% syllabus of CA, CS and Cost is same. The difference is of depth. But....nobody is stopping you to have indepth knowledge of any of the subjects which are not "directly" related to your profession.

As we are so much confused and depressed. Please tell is how we can look positively to cs profession in the new era of ca act, 2013. Please tell us the new exploring areas for cs in the new act and what we should do to specialize in which area which is best for cs fraternity.

Please try to enter into legal domain. If you can genuine handle legal with CS functions then there will ne no looking back for you.
