Articleship leave period and employment

Articleship 1200 views 5 replies

A student who has leave credit (180 days leave permitted during the tenure of articleship and has availed only 90 days so far) and his principal has no issue of him availing the leave credit of 90 days for rest of articleship period and complete the articleship. The student has already served the mandatory service period.

- can the student take up any employment - full time/part time at that stage(availed leave credit period)?

- is there any restriction even in that leave credit period he must not get into any employment?

Difficult query. Send ur query to e-sahayata in icai website.

You cannot take up any other course/ employment during your articleship period without prior permission from institute. Your articleship is not deemed to be over unless until your CA issues you service certificate vide form 108. So I don't think you can take up any employment right now without taking permission from institute. That's the rule.

However as suggested above, confirm this at e-sahayata.

S i too know the rule. There is also same rule do permit employment beyond office hrs. So Issue now is there is leave credit. Required period of articleship is served. so can take leave.

            - So if take up employment during will it be considered as violation of rules?

             - If can permit beyond work hrs y not beyond required serving period?

              - If required period is already served y not take up employment?

u are not permitted to take and job during period of articleship..

and leaves to be calculated as {Total period of articleship( 365* no. of years)-leave taken} /6

subject to max. of 180 days..

It is not necessary for an article to take 180 days leave. Someone can take 120 days leave, someone can take 140 days, etc. Your required period of articleship is the period for which you have signed the agreement. Also, every article has different leave eligibility subject to a maximum of 180 days, there is no hard and fast rule that everyone is eligible for 180 days.

And which rule are you talking about?
