Advocate Fees

Recently I had avail legal service from an Advocate. This service includes sending a legal notice to a client. I want to know whether RCM is applicable for the fees paid to advocate in exchange of services purchase from him? If, YES kindly provide me with the details.

Please read relevant notification u/s 9(3) which also provides definition of legal services provided by an advocate. If your case falls under that category definitely RCM will be applicable.

Yes... I agreed to Mr CS Abhishek Goyal's reply....

Rcm applicable for said advocate service and You will pay GST Tax under rcm basis @ 18%.

You can avail ITC also....

In term of Notification 13/2017 CT (R) , yes RCM is applicable

You need to issue self tax invoice & payment voucher self tax invoice format is of same TAX Invoice prescribed in rule 46 & for payment voucher kindly refer rule 52 of cgst act
