Service tax ST3 returns

I have already filed ST3 service tax return for the period April - September 2010. Later, I found out some minor mistakes, and tried to upload the revised return but it said that it will not accept the return as it has passed the 90 day limit. I contacted Service Tax Dept but nobody seems to know the procedure for online ST3 revised returns. Revised returns is still pending.

Is it okay if revised returns are not filed at all? Can there by any investigation in the near future regarding the same?

Well you did not mention your mistakes so just write a letter to central excise superintendent regarding this and may be they could permission you for rectification…

Service tax on rent on immovable property

First, ST was not charged under rent on immovable property beacuse of some dispute in the court, so ST was not collected. After October 2010, it was ordered that ST on rent on immovable property should be collected, and then we altered the invoice, added the ST and asked our clients to pay ST. We collected the ST and deposited in Bank. Byt the time all the clients pay, it was already february 2011. Then, ST3 revised return was not accepted because it crossed 90 days. And now again the ordered is reversed saying that ST on rent on immovable property need not be collected.

It was not a good idea to alter the invoice and add ST, but now that we have already goofed up, and ST3 is not accepted, what do we do now? Should I just let it go, or continue chasing ST department to find a way to file revised ST3 return.

Just contact to ST department if you don’t anything regarding this than may be in future you have to pay penalty for improper records maintain or submit incorrect information…

just write a letter to Assistant commissioner of your juridiction service tax, stating the facts and a copy of ST3, submit the same to AC office receiving counter under stamp, they will send u their approval in due course for acceptance of revised return.

I will do that. I don't know why after repeated reminders ACES are unable to resolve this issue. They don't know how to allow revised returns after the limit days. Now if I go personally to ST department, they will demand money to clear my revised return.

ACES is receiving counter for excise and service tax, they can not do anything of own.

i have told u to submit the same to AC, where a receiving clerk is deputed for mails only, unless u are taken in front of any officer, the cut money is not asked,

i dont think after submission of your leter with returns, they will ask for personal hearing and bribe.

dont get afraid of such "decoration" of industry, if youn are in industry, u have to face these and giving up is not a solution. go there make them understand, every level is supervised by a senior,

whenever the return could not be submitted by efiling you can always send by certficate of posting.

You may also send a complaint to the systems department your complaint by email copy marked to the asst commissioner if there are problems in dealing with the supt.
