Restaurant bill

Dear all,

as per hospitality industry norms tax is calculated on food bill plus service charge . kindly provide me justification that we can do so. any case law in support of this. its an fully ac restaurant with unique theme and ambience.

 

Also we do not charge vat on 60% of bill amount but on whole bill because we take input credit. is it ok..kindly provide me a proper explanation of the same,

you should divided total amount into two parts 40%for vat and 60% for service tax.

service tax is charged at 40% of value of bill and VAT is charged at 12.5% of the value of bill.

 

So 40% is Charged tax twice.
