RCM on Freight

Sir,
I am working as accountant in a company
and received a freight bill of rs. 10000/ from a transporter who does not have any gst no. and he has only one eeco van and he is driving his van .
and now I have to pay them so I am in confusion that is there rcm applicable for the bill or not .
if yes then what is the rate of rcm
and can we get the input on the rcm or not .
please help me .
and this transporter gave me the bill by his name only.
and he has provided me his pan no.

It will be covered under Reverse charge as Services from unregistered dealer and you will have to pay GST @ 18 and claim Input.

5% is for rent a cab and 18% is for transport of goods i.e. freight
5%RCM is on Goods Transport Agency. GTA. Means he has to issue a consignment note or lorry receipt else RCM will be 18% on Delivery Charges Pls check what did your delivery person give and accordingly pay RCM

Sir,
he has no any gst no and he has only one van
and he is driving himself,
so in this case rcm will be applicable or not ?
and he is giving me the bill on his letterpad.
no any invoice format
RCM will be applicable under Rent a cab service. tax 5% if rent & fuel one rate given.
if fuel charges paid higher rate to be paid.
check notification before payment.

YES, you will charge under RCM 5%RCM is on Goods Transport Agency. GTA. Means he has to issue a consignment note or lorry receipt else RCM will be 18% on Delivery Charges Pls check what did your delivery person give and accordingly pay RCM in case you issue self INVOICE with refrence no. mention in letterpad and received PAN no.

Sl. No. 9 of Exemption List

9.
Services by way of transportation of goods
(i) by road except the services of—
(A) a goods transportation agency; or
(B) a courier agency;
(ii) by inland waterways;

So, when the service itself is exempted, then will that be considered for RCM u\s 9(4) ?

than can we take input on the paid rcm or not

I am , a buyer registered in HARYANA receives GTA services from a logistics which is registered in Rajasthan by way of Transportation of Goods from 'B' who is a registered Dealer in Rajasthan.
The goods purchased(soya doc which is exempted) from Rajasthan from registered dealer, by us, as consignor ,are exported to Nepal Party,which in case is consignee.
The transporter is registered & he do not charges GST than is it duty of consignee pay GST & get input credit of GST.
Now is it duty of consignee to pay GST. Please advise .
In this Case how the GST is paid under Reverse Charge Mechanism
