Gstin not received even after 3 weeks! harassment alert!

Hi there,

I have applied for GST registration nearly 3 weeks ago but has still not been approved. When I check the status using the ARN number - I get "Pending for Processing" and in the assigned to column - I see it as STATE.

The next thing I did was I called up the GSTN customer care - and they said that registrations have been slowed all over India and that I'd have to wait for a few more days.

The next day I went to the local VAT office where this particular firm's jurisdiction is assigned to and the officer asked me for Rs. 5,000/-  and he would approve and grant the GSTIN on the same day.

Kindly let me know what should I do. 

In GST registrations - this is the first time I'am encountering this. Is it ok for the department to not grant registration even after so many days. Note that I have not received any SCN (Show cause notice). I have even mailed the GSTN helpdesk but no success yet.

Any advice would be greatly appreciated.

Hello Sir, You should not have visitied the local VAT office, I will recommend you to wait as officer will have to take action in specified time frame. I was in same situation and my application was approved automatically by system based on "deemed approval" because officer did not take any action in 20 working days.

The "pending for processing" application needs to approved in 3 working days so just lodget complaint with GST center on phone and take complaint number, Your application will be approved very soon.

Sorry for the late reply, yes I received the GSTN number and I (or my client) did not pay bribe. Even after 18 days when I did not receive the GSTN # I mailed complaint to helpdesk @ gst.gov.in citing my TRN & ARN number and I think that helped and I received it after 3 or 4 days.

The disgusting thing that happened was that my client thought that the delay was from my end and he went himself to the commercial tax office and he requested them to process it as soon as possible to which the officer asked for Rs. 5,000/- !! And he said it'd take one more day. What he and my client didn't know was that the GSTN had been generated and I had also received the email the previous midnight LOL! All thanks to God.

I feel that such long delays are due to callous tax officers rather than the system. Cases which are assigned to STATE specifically - my personal opinion.

AS Per the ruling of GST Act, the proper officer shall have to approve the application within 3 working days from the submission of the Application if there is no action taken by the proper officer the application shall be deemed to have been approved.

True but that's only in theory, in practice, of the about 40 registration that I have taken, only about 2 of them have been granted GSTNs within 3 days, for others 4-10 days. What would you tell the client if he comes to you after 3 days of applying for registration? All he needs is GST certificate & number, nothing else.

Yes, it is very true that local officers at state level are intentionally delaying the approval ..so that the person in urgent need of Registration will meet them and they could ask for 3-5,000 just for approving the genuine application. If no one contact or visit them then after 7days they again intentionally issue lame SCN in which they ask for Bank details, Purchase Sale invoice, PAN or Aadhar copy, even if you have already provided all these details...this SCN is issued with an object to delay approval for another 7days and force the person to visit and Pay them the demanded bribe.

Hence, it is advice to attached all the documents including Premises photo in compressed pdf so that they can't raise any unnecessary objection. And if even after providing all documents still they demand the same then you can file appeal against such order, but yes you have to wait for a few weeks for all these procedures.

If your application is assigned to Center, then you will not face any such unnecessary difficulties and will get the registration at the earliest.
