Eligibility to Gratuity

Dear Members,

 

Whether an employee is eligible for Gratuity if he has not completed 5 years of service? If an employee has served for 4 years and 9 months, will be eligible for gratuity?

 

Please support your answer with suitable provision/case law.

as par sec.4(1) gratuity shll be payable to employee on termination of his employment after he has rendered continuous service for not less then 5 years ....................

this section is apply in all cases but there is an exception which is ...

on the death and disablement due to accident or diseases ..his section will not apply
