04 September 2013Recently I find that one of my Friends is getting TDS deposited every year in his account. But since he is not an assessee to file return, he either did not claim TDS amount nor filed his Return for the past 5 years i.e., from AY 09-10 to till date, The total TDS amount is around Rs100000 for 5 Assessment Years. Is there any possibility to claim TDS amount of the past 5 years now?

Has he deposited the TDS deducted into his personal account or deposited into the Govt ?

Since he has not filed the return, he cannot claim such TDS amount as TDS can be claimed only in income tax return. However, he can claim by filing IT return for last two assessment years.
