Complained to vinod Jain (Non-adherance of Regulation 60)

Hey friends, i have mailed to Vinod Jain (member of the Central council of ICAI & also former chairman of Board Studies) regarding non-adherance of Regulation 60 (working hours of Article Trainees) of CA Regulations, 1988 by Practicing Chartered Accountants. Please read below regarding my correspondance through mail with him

I am CA Final Student. I have a serious grievance regarding Articleship. 

  According to Regulation 60 of the CA Regulations, 1988-

"The working hours for the articled assistants should not exceed 35 hours in a week excluding the lunch break and normally an articled assistant be required to work during the normal working hours fixed for articled assistants. In case of the exigencies of work with the Principal, an articled assistant may be required to work beyond his/her normal working hours. However, under such circumstances, the aggregate number of working hours shall not exceed 45 hours per week. The requirement to work beyond 35 hours in a week should not be a practice but only in exceptional circumstances. Further, where the articled assistant is required to work beyond normal working hours, and aggregate of such hours exceed 35 hours per week, he/she shall be entitled to compensatory leave calculated with reference to number of completed working hours, over and above, 35 hours per week."



But unfortunately atleast 9 out of 10 CA Firms are contravening this Regulation. Generally, the minimum working hours in a CA firm for an Article Trainee are around 45 hours in a week (excluding lunch break). And in the audit season i.e., from May to September, the working hours goes well beyond 50 hours.



I agree that Articleship is a very important part of Chartered Accountancy. But at the same time, we should spend time for the preparation of our exams as well. Because, it is only when a student clears the exams he/she will become a Chartered Accountant no matter whatever the amount of Practical Knowledge he/she may have.



Hence I request you to take an immediate action in this regard.

Now Friends please tell what evidence i can provide to him. I find it strange that he is not aware of the working hours of Article Trainees in CA Firms.

 

I request the students and experts to give their views in this regard.

everything provided by you will not be entertained by the ICAI

because this happens with every student and they always favour their members

Really..this is terrible..what evidence can he provide to our institute..why institute is not taking any action..but why can't u mention the firms which u have seen..???

You may ask him what evidence he requires in this regard.



You can provide copies of attendance register's sheets. You have to provide any such proof which will support your claims. If you don't have any proofs, then they can't help. You have to understand this basic fact.

YOu are correct in this regard. Most of the CAs are not following this regulations.I too am facing the same problem but to mantain the peace & relationship, I have decided not to compliant against him.However, if you are facing a grave situation, You always should raise your voice.
If u are facing the trouble of working beyond the stipulated time provide your time sheet whether signed by your principal/partenr or not..ALso if possible for you attach time sheet of other artickes working in your firm. That will form a strong evidence to take action against your principal. I will advise that all the articles of your firm collectively lodge a complaint against him.

Institute will not take action against its memeber.   it brings disgrace to institue.

read the below lines and decide.

"a Chartered Accountant disobeys rule....."

"ICAI takes a stern action against a disobedient student...."

the first line hinders the profession   whereas the second line shows how strict the institute is...   presenting a better and filtered output to th enation.

 

you can take a chill pill...  nothing is gonna make institute take action against mebers.

Yes, Institute should moniter articlesip in such a way that the members and students adhere with all the relevant regulations.

Just wondering, if you give them the name of the firm, working hours they can go and check themselves. also the timings are posted on the notice board
