12 May 2012 Is there any time-limit to refund the excess tax depositd to the Individual Assessee by the ITO?

12 May 2012 There is no such time limit. But the better option is that if excess tax is deducted, better file TDS return with that excess tax deducted. Further, let the deductee claim the TDS in his own return. That will reduce the time for receiving the excess amount.

12 May 2012 Directly there is no time limit but Indirectly there is time limit. yoour TDS return has to be processed within one year from the end of financial year in which return is filed and demand or payable has to be decided by the ITO u/s 200A. hence, you can expect refund within one year. if not please give letter to ITO for processing of the same.

My query was relating to delay of excess TDS made and deposited by the employer from his employees salary.

It is understood that there is no scope for any adjustment by the employee while filing his next Return.Further , it appears that there is no specific time- limit laid down in the Act to get back the refund.

In view of the above , the only alternative option available is exactly the suggestion given by Respected Shri Chaitanya Chirukuriji.

It is understood that there is no scope for any adjustment by the employee while filing his next Return.Further , it appears that there is no specific time- limit laid down in the Act to get back the refund.
