leaving of job without notice

03 April 2008 Can anyone of you pls tell me what r the consequances of leaving the job without notice.
I did not sign any bond but i signed my appointment letter according to which i have to pay one month salary in lieu of notice.
But if i don't want relieving letter than it is necessary to pay the notice period salary.

03 April 2008 The terms are contractual in nature, if you have signed the letter in token of accepting the terms and conditions of appointment. The notice period of one month is reasonable.

The consequences are you may not get the relieving order. The company, if it is worthwhile may legally demand the notice pay.

04 April 2008 I want some more opinions.


05 May 2008 Legal consequences : 1) company can take legal action and in addition of notice period salary it also can demand for any losses it incurred due to your leaving without notice (notice is compulsory whether u pay notice salary or serve for notice period).
2) company might have entrusted you with any responsibility like authorised representative in sales tax or income tax, maintaining statutory records etc. under company act or income tax, if you don't get relieving letter, you are still liable to discharge those duties.

personal consequences : 1) if you are going to any good company for new job, it will ask for relieving letter, if not provided then it will treat you like a fresher (means you waste ur time in old job)

if you are worth to hire, new company can buy the notice period means it will pay you for that amount (matter of bargain).

19 June 2008 Very simple you have to pay one month salary to the company..which is just a penalty

After paying that salary the company must give the relieving letter.
