Dear All, A trust is located in Maharashtra and wants to setup its activity (related to service) in the state of West Bengal for which few machineries shall be bought in West Bengal. Can the said machinery be purchased against C form when there is no output tax and besides if it is purchased from West Bengal can the setoff be refunded if the trust gets registered as casual dealer?

When you are doing only a service activity-it is common to all states- a registration under WB VAT Act can not be given. Secondly a C form can not be issued for purchase of machines for job/service work. It should be only for mining or a manufacturing purpose as per CST Act...mjk
