Valid time period of a approved name of a company

20 June 2012 Hi Sir,

A name approved is valid for a period of 60 Days.

Up to how many number of days one can apply for incorporation ie FORM 1,18,32 ?

A case study:-

Name Approved on 06/04/2012

Applied for incorporation on 05/06/2012 with FORM 1, 18,32

ON 07/06/2012, PATNA ROC REMARKS:
Required PUCL- (1) Particulars of signatories to the MOA & AOA shall be written in their own handwriting as required u/s 15(c) & 30(c) of the Act. (2) Decleration for Hindi signatory to the MOA & AOA to be furnished by 06/07/2012.

FORM 67 FILED AS REQUIRED ON 18/06/2012 within the time allowed ie 06/07/2012.

ON 19/06/2012,PATNA ROC REMARKS:
On approving the wok-item, the system gives message that the name approved has been expired. Therefore, applicant is requested to first obtain name again and thereafter resubmit all forms i.e. 1,18 & 32 by 06/07/2012.

Quary?

How this had happened?
What should i do? i have deposited the fee for the incorporation?
What would be the course of action?

I have already face the same problem, you just file Form-1A with the details of last Form-1A SRN and accordingly you will change the subscription page of MOA/AOA because new SRN will generate for you Form-1.18 and 32. Subscription page will be signed after new name approval.

Date of approval will be taken into account for counting period of 60 days for name approval.

ROC COMMENT,
"applicant is requested to first obtain name again and thereafter resubmit all forms i.e. 1,18 & 32."

I NEED TO RESUBMIT, THEREFORE THERE SHALL BE NO NEW SRN AND ALSO I THINK I SHOULD NOT HAVE TO PAY THE FEE FOR THE INCORPORATION AGAIN.

21 June 2012 I am talking about Forms which form u have to file. it is Form 1, 18 and 32 or Form 1A.

21 June 2012 I think i have to file FORM 1A to get approval of the name that has expired.
There after i should resubmit FORM 1,18,32 with with the previous SRN of Incorporation by 06/07/2012

Old SRN will be available only when u have applied for extention of name approval, but you have not taken extention of such name.

As per my understanding following step will be follow by you:

1. File New Form-1A, with details of old SRN
2. Get approval of new name with new SRN of Form1A.
3. When u fillup Form-1 with this new SRN the approved name will automatically show in Form-1.
4. After approval of name subscription page of MOA and AOA will be handwritten and signed by subscriber.
4. File All incorporation Forms with ROC.
