07 March 2012 My client has TDS deduction for the I st qtr and III Qtr and has filed the returns in time.For the IInd and IV qtr there were no TDS deduction.Please clarify whether we have to file nil return for these qtrs.

Please reply back.

07 March 2012 Yes; even-though no deductions in a quarter one should have tan no must be file quarterly returns. But maximum are following only filed for the quarter in which deductions has made but it is wrong practice.

08 March 2012 ITD and NSDL are frequently advising all TAN holders that they should file all quarterly statement in case they have filed for any quarter, because it helps hem update their data base. Yes however where you have filed none, you are not required to file NIL returns for example you have filed quarterly statement for "Other than Salaires" for any quarter, you must file it for all the four quarter but at the same time you may opt not to file statement for "Salary" or "TCS" or "Payment to Non-Residents"
