Service tax liablity

05 April 2011 Dear Experts,

I have gone through records of one of our clients. They have not paid service tax on certaing bills though it is more than two years, stating that they have not realised amount from customer.

Is there any period limit for liablity or it is indefinite till asesse realises amount from customer

07 April 2011 There is no time limit for this liability for the invoices issued before 31.03.2011 as per the saving clause in the new point of taxatin rules,2011.Because in the provisions of relevant rule 6 of ST Rules,1994 ,as applicable at present,the mode of payment is on the basis of actual receipt towards the invoices issued for services provided/or advance receipts .For future invoices that is after 01.04. 2011 invoices pl.refer to these sited Rules.For CAs etc they are not applicable.For others they will be applicable from 01.07.2011.CA.SAGAR MAL PAREEK

19 April 2011 Service tax is required to pay once the payment is received by the service provider. There is no time limit for this liability
