17 February 2011 Supreme court vide its order in case no. 16960/2010 dated 10.01.2011, issued an interim stay on the Delhi High Court's stay order No.3398/2010 dated 18.05.2010.

This situation is continued to be in force till the Delhi High Court gives any final verdict in case # No.3398/2010.

So at present, Service Tax recovery on rent is applicable.
