Medical professional tds 194j

18 June 2013 Our assessee is a doctor employed by assessee on salary basis.
But hospital is deducting and depositing tds u/s 194J.
My question whether we have to show income as salary or we have to prepare books bs & pl and file ITR-4,
if yes then how can i prepare as our assessee is having only salary income.

18 June 2013 If you want consider Any income considered as Salary, there should be an employer and employee relationship should be exist or past, since the hospital deducted the tds u/s.194J, then it should be an contract nature or retainership basis. so need to file ITR-4.

19 June 2013 Sir, there is fixed income received per month and it is employer - employee relationship.
But sir, if retainership basis then can we claim expenses like conveyance, telephone etc against income received.




19 June 2013 Incase retainership basis, then income covered under professional, so you can claim the expenses related to professional
