Loss incurred due to cancellation of booking of flat

23 April 2013 Plz let me know that if an Individual pays the cancellation amount due to cancellation of Flat which was Booked earlier, then what is the treatment for that.
Is that taken as HP Loss or Capital Loss.
Plz help me as soon as possible.
