It return

This query is : Resolved

14 April 2016 Dear Experts,

One of my friend working in private company. He was not received the salary for last 7 months because of company not in position to pay the salary amount but company deducted the TDS on salary as provision basis.

He is not sure that the company pay the salary for remaining months. Total salary for the f.y. 2015-16 was Rs. 3,60,000/- but the TDS was deducted only Rs. 6000/- .

If he file the return he was liable to pay the tax on income.

My question is,
1. It is required to show salary for 12 months.
2. What can be happen if he show the salary for 5 months.

Thanks in advances

14 April 2016 I think company is booking salary on provisional basis so that you salary was credited on every month and tds also deducted. you have to ask your company to give form 16 and on which you can file return. if your company will show your salary by provision then when they will pay to you in next year you don't need to pay tax on receipt basis or also take relief u/s 89(1) but if you take in current year accrued basis then it will be fruitful to you.
