Hra exemption

26 June 2016 My salary is Rs.535950/- pa. Out of this Rs. 1,73,160 is paid as HRA. But, employed has deducted tax on this. However, I have paid rent of Rs.36,000/- for residential accommodation. While filing my return can I show my salary after deducting the rent paid by me, as Rs. 499950/- (Rs.535950/- less Rs.36,000/-)?. Kindly enlighten.


26 June 2016 Why the amount paid as rent not disclosed to your employer? Still while filing return you can compute this amount as per provisions of section 10(13A). The least is exempt :
1. Actual of HRA received
2. 40% (50% in case of metro cities) of Salary
3. Excess of rent paid over 10% of salary.

Note: The computation might alter your Form 16 given by the employer and may yield you in probable refund. At that time you need to satisfy the Assessing Officer of the amount paid as rent to your landlord.
