Form 32 of a Past Director

20 October 2009 Can someone tell me, if the CLB has any jurisdiction, to allow late filing of Form 32, when the Director has been removed from office almost a year back.

If yes, then please give me relevant sections.

If no, then please tell me a remedy in such a scenario.

20 October 2009 Hi,

No need to search any section for late filing. It is very much allowed. In fact MCA provide a slab for late filing fee.

So you can file your form 32 with late filing fee. When you upload your form 32 on MCA site then challan will show the normal fee along with late filing fee.

So go ahead.

21 October 2009 Mr. Ankur is right but it is on ROC 's discretion it can reject the form-32 or levy some more the aditional fees

Thank you very much. But what I am looking for is case laws or sections, in which after the late filing was challenged, the respondents won the case.

Does the Company Law Board has any kind of Jurisdiction in such scenario, to late filing or penalize for non-timely filing?
