28 September 2011 Hi,

This is CA. Amit Khare, I want to ask if you can please provide me the circular or proviso related with Salary Payment to Expat joined in India. e.g. USD 2500/- is fixed to be paid in equivalent INR. what would be the exchange rate of conversion can it be fixed by the compmpany as standard rate and will be subject to revision in case of substantial fluctuation in rate. or it has to be reviewed every month end as per market rate. kindly advice

29 September 2011 That's the choice of Company to pay at which rate , Income Tax shall be leviable on the converted amount in rupees.

However it should be better if the same is looked upon every month.

29 September 2011 Rightly said by anuj. Just to add that there is no specific circular dealing with expatriates salaries payments. Since he is serving Indian company income arises in India and consequently taxable as other Indian employee.

29 September 2011 Better & prevailing system option is payment dates Forex rate conversion & TDS on the amount.
