Deducted tds was not credited fully on my pan

i am working in government sector,
for the f.y 2012-13 29000 tds was deducted from my salary but 9000 only credited in pan(as per 26AS)

now i received notice from income tax department for non filing of IT Return

if i file it return then they will send demand notice

now what i have to do

05 April 2015 Ask your employer to submit revised TDS return to enable you to get credit of TDS actually deducted from you.

Last date of filing belated return u/s 139(4) for FY 2012-13 i.e., AY 2013-14 was 31.03.2015.

So you can not submit return online now.

It is advisable to always check your 26AS periodically to ensure TDS deducted from you has been credited in 26AS.

already i asked my employer to do this but they did not take any action

can i take any action on my employer through lawyer or please advise me

Check out above link. Go and meet your jurisdictional AO with the notice and prepare a Manual return claiming TDS amount actually deducted from you. I hope you have TDS certificate of full amount. As you can check out from above link, department can not deny you TDS credit just because it is not appearing in 26AS.

You can take services of a professional to assist you better.

06 April 2015 Mr. Sanjay Gupta how can he has TDS certificates of full amount..it is not reflecting in 26AS so TDS certificate also can not generate.

06 April 2015 Many times employer give manual TDS certificate wheb they are at default. Otherwise salary slip showing the TDS deduction will be sufficient.
