Confirmation on rate of tds

can anyone please advise me on the TDS rate applicable under section 195 for Professional Fees. Payment is to be made to a company in Italy. The company has a valid PAN and TRC in India.

21 June 2013 It is subject to the country DTAA, in case DTAA specifies the special rate then DTAA rate otherwise normal TDS need to deduct u/s.195
