Thank you Ganesh for your reply, was expecting from you..long time we have not spoken over here...how were your exams...Can you tell me whether all the sections of Co Act 2013 have been made effective or not ?

As on date only 282 sections of Companies Act are in force. For rest Companies Act 1956 applies. Caro applicable for Audit Report of FY 2013-14.

Thank you Sanjay Sir and Rakhecha Sir for your replies, but sir I would really like to know by which notification, circular or any other order it has been clarified that "the corresponding provisions of Co Act 1956 would continue to be applicable if the same provisions of Co Act 2013 have not been made effective" ?

Dear Ganeshbabu I've seen this already, sorry my previous post was not much clear, in my previous post I wanted to ask (not in respect of Auditors' Report, which has been already cleared by ICAI notification and MCA circular) whether MCA has at any time said that if some provisions of Co Act 2013 are not effective then the provisions of Co Act 1956 will remain effective to compensate the same. Again I want to make it clear that I want to know the case as a whole and not that section which talks about audit. Please reply.

Dear Vaibhav there is no such notification which states that if Section of CA 2013 is not in force then corresponding provisions of CA 1956 will apply.
From 12.09.2013 98 sections out of 470 sections were notified. More sections were notified from 01.04.2014. As on date total 282 sections are in force. Rest yet to be notified.
Since the sections are being notified in a phased manner provisions of CA 1956 are not completely replaced. These are replaced only to the extent of Notified Sections. So the sections which have not been replaced continue to apply. MCA has not issued any such notification which you are looking for.

As per MCA General Circular No. 8/2014 dated April 04, 2014, there is no need to follow Annual filing related provisions of Companies Act, 2013 for the annual filing related to financial year 2013-14.
